The Service is intended to provide the electronic equivalent of a “Box” in which you might store a photograph album or a "Scrapbook" which can be shared with your family and friends on the same basis you would share your photographs. Some of the key features include:-
The Service will handle many popular media file types however not all file types will always be supported.
New members will pay a subscription fee which includes an allowance of storage space which is free of charge. On the website we will maintain and publish a price list and in line with your use of storage space and other features of the Service you may be charged fees.
When you create a new Box or Event you become the Owner of that Box or Event. Our fees and your usage statistics are calculated separately for each Box or Event where you are the Owner. Your usage includes all Content in your Boxes or Events including Content placed in your Box or Event by others you have invited to participate.
We provide tools to assist and you agree to monitor the size and suitability of Content in your Boxes and Events
We reserve the right to offer promotional discounts and benefits to new members and at our discretion these may not be available to existing users. If you do not maintain your subscription we will have the right to terminate your account
You will need to register a unique Username and Password for your sole personal use which you agree to maintain regularly and keep confidential.
You will be asked to provide us with your email address which must be validated. You agree that legal notices and formal communication will be sent by email or displayed through the Service.
Your account may be terminated or suspended by us at any time. You may terminate your account at any time using the options provided online.
The term "Content" shall mean all of the media files, documents, text, and other materials uploaded to the Service.
You agree that when you upload Content to the Service you automatically grant us an unrestricted perpetual license to use such Content for the provision of the Service. In addition to this, if you add Content to a Box or Event owned by another person you automatically grant the Owner of that Box or Event an unrestricted perpetual license to use the
You agree we are allowed to display, send, print, or modify your Content in order to provide the Service as intended. We are the owner of all intellectual property rights in the Service including all software, Trade Marks, images, designs of all kinds, and all media and works created by us.
To the extent permitted by law, our liability for any loss whether direct or otherwise you suffer through breach of this Agreement is limited to the price of the Product you purchased.
We will not be liable or responsible for any breach of contract or impairment of service caused by events outside our reasonable control ("Force Majeure Event"). We will use commercially reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may continue to be performed.
You are responsible for keeping your Username and Password confidential and you accept that you may be liable for actions performed through your Username.

We cannot monitor all individual Content uploaded by users of the Service and it is possible that unacceptable behaviour may occur in breach of our rules.
We will investigate and take action to remove unacceptable content when we become aware of it. We shall not be obliged to communicate the outcome or findings of our investigation nor shall we be obliged to act in any specific timescale.
We will cooperate with national law enforcement agencies at all times and we will report incidents and activity where we believes the law has been or could have been broken, or others may be at risk.

The term "Product" shall mean any subscription or goods or services offered for sale within the Service.
An Order is raised when you confirm your purchase online and this is directed to our secure payment handling agency. Your Order is deemed to have been accepted by us only when you receive confirmation from us or our payment agency that your payment has been received.
We do not have access to your payment card or payment account information. The terms of business and the security provisions of our payment agent can be viewed online.

We will use commercial couriers and postal services to deliver Physical Products meaning items not in electronic form, such as hard-copy photos and albums. For that purpose you agree we may provide your name, address, and a contact number. We will deliver only to the address you have provided and a signature may be required on delivery. The courier will communicate with you to manage the delivery process
Products which take the form of electronic media and / or online services will be delivered online and confirmation will be sent by email.
We may use third party specialist suppliers to manufacture and deliver Products such as personalised gift items or hard-copy photographs and in this case we will use reasonable endeavours to ensure timely delivery. For that purpose you agree we may provide your name, address, and a contact number

Free Account: On joining the Service you will receive an initial free of charge storage allowance of 250Mb.
Additional space can be purchased as follows :-
You will be able to earn more free storage space by introducing other new Users and through promotions offered by Treasured from time to time.
Treasured reserves the right to terminate Free Accounts with 30 days notice. Without limiting the generality of the foregoing, if a Free Account is inactive for ninety (90) days, then Treasured may delete the account and any content therein without providing additional notice.
If you do not maintain your payments and your account falls into arrears Treasured shall have the right to suspend or terminate your account.
Treasured will automatically bill you on a monthly basis and you acknowledge that the amount billed each period may vary for reasons that include, differing amounts due to promotional offers, differing amounts due to changes in your account, or changes in the amount of applicable sales tax, and you authorise us to charge your credit card for such varying amounts.
If a Physical Product is defective you can contact us at sales@treasured.com to request a replacement or refund. We will require evidence of the defect and a defect exists only when a Physical Product does not comply with the description carried on our website. For the avoidance of doubt you accept that minor variances in image and colour reproduction shall be acceptable, and low resolution source files may appear blurred when reproduced. If you wish to cancel an Order for a Physical Product you must contact us immediately by email to sales@treasured.com. Orders for Physical Products may involve automated production processes and you accept we are not obliged to accept your request to cancel an Order. Unless a Physical Product is defective you will be responsible for any return post and packaging.
All prices quoted on the Service are inclusive of VAT and similar local sales taxes if these apply.
We do not offer refunds against subscriptions and or other payments for online use of the Service or electronic products.
Treasured may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email. You agree to check our website for current price lists in addition to such emails.
Your Treasured Account will continue in effect unless and until you cancel your Account or we terminate it. You may cancel your Treasured Account online at any time, and cancellation will be effective immediately.
You may request us to cancel your account in writing by email or by land-mail at the address provided on our website in which case you agree you will use a recorded delivery land-mail service giving a return address and termination shall take effect only at the end of the billing period in which we have acknowledged receipt of your cancellation request.
By signing up for a Treasured Account and providing Treasured with your payment account information, you hereby agree to these payment terms and conditions.
